Terms of service
These terms cover your use of MobyVid: the web studio, the API and the MCP connector. You accept them when you create an account or buy credits.
Development view: fields marked “To be published” don't appear in production. Fill them in before launch.
Who provides the service
The service is provided by the owner listed in the legal notice:
Your account
- You must be 18 or older.
- Use real details and an email you control. Keep your password and API keys safe: anything done with them counts as done by you.
- The welcome bonus is one per person. We may remove free credits obtained through duplicate accounts.
- You can use MobyVid personally or for your business. Consumer protection rules only apply when you buy as a consumer.
How the contract is made
- Steps: you create an account, verify your email, pick a pack, accept these terms and pay on the merchant's checkout.
- Before you pay, you see the pack, the credits and the final price with taxes. You can fix your details or go back until you pay.
- We keep a record of every purchase and email you a confirmation. These terms always live on this page, and you can save or print them.
- The contract can be made in Spanish or English.
The service
MobyVid makes ads, images, videos, voiceovers and music with third-party AI models through kie.ai, and assembles the formats with our own tools.
Every take shows its price in credits before it runs. AI results vary: we don't guarantee a specific result or that it fits a particular purpose.
Models depend on their providers. We may add, change or remove models and formats, and the service may have outages. We don't offer a service level agreement.
Credits
- Credits you buy never expire.
- The price of each pack and each take is on the pricing page.
- Free credits (the welcome bonus and each pack's bonus) are spent like purchased credits. The welcome bonus has no cash value.
- Credits can't be moved to another account or exchanged for cash, and they only work on MobyVid.
- If a take fails, we refund its credits automatically. Same if you cancel a take before it starts.
- You can ask for a refund of unused purchased credits within 14 days of purchase. The refund policy explains how.
Payment and merchant of record
Payments are processed by a merchant of record, which takes the payment, issues the invoice and applies taxes. To be published
- Prices for EU consumers include VAT. The merchant of record works out taxes for your country.
- We only add credits to your account once the merchant of record confirms the payment.
API and MCP connector
- Your API keys give access to your balance. Keep them secret, don't share them and revoke them if they leak.
- Requests your AI agent makes with your key count as yours. You're responsible for what it generates and spends.
- You can set a daily credit cap per key. We recommend it if you use agents.
- Stay within rate limits. Send an Idempotency-Key header so a retried request isn't charged twice.
- Don't resell direct access to the models or share keys between customers.
Your content
- What you upload stays yours. You let us store it, process it and send it to model providers only to provide the service.
- You confirm you hold the rights to what you upload and have consent from any identifiable person in it.
- Reference and motion videos must be your own footage or licensed for this use.
Your results
We assign to you whatever rights we hold in the results you generate, so you can use them in your ads.
We don't guarantee exclusivity: someone else may get similar results. AI-generated content may not be protected by copyright.
Some model providers set their own commercial use terms, especially for music. Check that you can use each result the way you plan to.
Acceptable use
You may not use MobyVid to:
- Impersonate real people or use their face, body, voice or name without their consent.
- Make content featuring celebrities, public figures or politicians, or look-alikes of them.
- Use copyrighted characters, scenes, logos or music without the rights.
- Create fake reviews or testimonials, or present a generated person as a real customer.
- Make misleading health, medical, weight loss or money claims, such as cures, guaranteed results or guaranteed returns.
- Create fake before and after shots, fake scarcity, fake prices or ads that pose as news.
- Create sexual content or nudity.
- Show realistic depictions of anyone under 18, in any context.
- Run political, electoral or social issue ads.
- Promote illegal goods, counterfeits, weapons, drugs or unlicensed gambling.
- Spread hate, harassment, violence, scams or phishing.
- Remove or alter AI labels, content credentials or watermarks, or pass off AI content as made by people.
- Get around the safety filters of models or platforms.
- Download content from social networks in breach of their terms.
- Break the ad policies of the platform where you publish.
Labeling AI when you publish
When you publish, it's your job to disclose that content is AI-generated wherever the law or the platform requires it.
In the EU, if an ad shows realistic people, voices, places or events that could pass as real, you must say so (AI Act art. 50(4)). Meta and TikTok also ask you to label AI content.
Moderation and suspension
- We use automated filters, ours and the model providers', to block prohibited requests. A blocked request isn't charged, or it's refunded.
- If you break these terms, we may block content, pause or close your account and notify authorities where the law requires.
- We tell you the reason for each action. You can appeal by replying to our email.
- If we close your account for a breach, we refund your unused purchased credits, except in cases of fraud.
- You can report illegal content or abuse as described on the AI transparency page.
Liability
We provide the service with reasonable care, as is and as available.
We aren't liable for indirect losses, such as lost sales or lost data, or for how you use the results.
Our total liability is limited to what you paid us in the 12 months before the claim.
If you use MobyVid for your business, you're responsible to us for third-party claims caused by your content or your ads.
None of this limits your legal rights as a consumer or our liability for intent or gross negligence.
Changes to these terms
If we make an important change, we'll email you 30 days in advance. If you don't agree, you can stop using the service and ask for a refund of your unused purchased credits.
Governing law and claims
The laws of To be published apply.
If you're a consumer, you keep the protection of the mandatory laws of the country where you live, and you can bring a claim in your local courts.
Before filing a claim, email us at To be published. We'll try to sort it out with you.
The service and these pages are available in Spanish and English.
